despatch of September 4th confidential. Enemy owned trade

It appears that these marks are owned by British

manufacturers and formerly applied to goods distributed

marks.

The marks were therefore the subject of a joint venture

between the two parties and now that venture is suspended

use by one of the parties alone will be misleading decep-

tive and contrary to principles of Trade Marks Law since

use of the marks implies that the goods have passed

through hands of both parties. Use by person having per-

mission of enemy party will be equally improper since

right to use mark could only be transferred by enemy if

accompanied by bona fide transfer of his business includ-

ing goodwill which is of course impossible. In the

circumstances user of such marks should be prevented by all

possible means legislation being passed if necessary. Any

such legislation should state plainly the above reasons

which make user of the marks improper.
